This is done by estimating the present value of one dollar in the future, based on the estimate of years the victim was foreseen, to live and an annual interest rate. Once that value is established, it is multiplied by the victim's annual salary.

A severe shortage of public transportation made a taxicab out of anything on wheels. Numerous businesses relocated teporarily in Oakland and many refugees found lodgings outside the city. April 11, 1965 is still remembered by many: that day a brutal string of tornados hit the states of Iowa, Indiana, and Michigan with wind gusts as high as 318 miles per hour, killing 250 people and injuring some 1500 others. The first funnel cloud hit the ground at 1 p.m. With others following at varying intervals, up to 5:30 pm. The storms intensified as they day progressed. An F4 storm hit Koontz Lake, Indiana and 2 other twisters hit Wakarusa, and Goshen, doing massive damage to homes, and local infrastructure.

More storms continued to found over the course of that same day. The worst of the tornados, an F5 storm with winds reaching speeds of up to 318 miles per hour landed at Elkhart Indiana and destroyed the Sunnyside subdivision killing over 30 people. One of the funnel clouds was a ample eight hundred yards wide, leaving a trail of devastation in its path. Telephone and electrical lines where knocked out by the high winds. The phone system was down and, as a result, local city officials where unable to warn others in the path of the storm of the severe danger. The day progressed and tornados hit many other counties. The damage from all these rapidly occurring storms was devastating.

Damage History

The impact that these storms had on the area was huge. The U.S. Weather bureau conducted a full investigation after the storm and established the need for better methods to delineate warnings to residents and officials in other areas of approaching storms. It was just a diminutive while after this that the Weather service started to put out announcements indicating that tornados where likely to form and where they were traveling once they had hit the ground.

The economic consequences of these storms were felt in all three states. Houses where completely destroyed, and all the major utilities took damage. Local businesses had to close and supervene repairs and millions of dollars had to be spent to clean up the mess that was left by the roving storms. The loss of company and personal facts alone can hardly be calculated.

Once again local residents and company across the three states where caught by surprise and hurt or killed as a result. Tornados by there very natures are very hard to forecast. Unlike other storms that can be seen as they approach, a tornado can, in effect, form right on top of you and hit you when you least expect it. The need to take proper precautions is essential to ensuring the protection of local residents and businesses. Yet even that may not be enough. Protecting your own company infrastructure, records and facts can be an essential component to your own salvage process in the event a major disaster strikes.

And the rule is that the Nasa Administrator - whose areas of background expertise can hardly embrace all the discrete technologies of risk and concern - is required to make all considerable decisions. And since life-and-death, plus hundreds of millions of dollars in program hardware and costs are complex in every mission, how that is done is a unique advent to technical and administration problem-solving.

In essence, before each flight, Nasa conducts a Flight Readiness characterize (really a tutorial) - taking some days, where-by every inherent threat to a successful mission is fully examined and reviewed - in technical, educational information - presented by the best experts in industry and government - addressing the Administrator and his staff. Early orbital flights and the Moon (Saturn) program handled the extremes and uncertainties of re-entry heat by employing very conservative thicknesses of ablative material on the underside of the re-entry capsule - which landed in the ocean. For the Space Shuttle, the view was an airplane-type vehicle, which would land on land (although lacking motor propulsive power, like a glider). The re-entry heat question was (theoretically) solved by the straightforward view of "insulation vacuumized tiles" (six by six inches, thicknesses about an inch) - providing insulation via the quality of a vacuum to block heat transference.

The tiles, a improvement of Nasa and Hughes Aircraft, were fabricated of fibrous quartz, filaments stuffed in the tile, double-vacuumed, and covered by a thin glass exterior. (Note: the inside of a tile looks like straightforward styrofoam.) The processing improvement was highly difficult - as evidenced by the cost: each tile (there are 30,000 per Shuttle - photos of the Shuttle showing "black" on the underside of wing, fuselage, tail and the nose are these thousands of 6 x 6 tiles) - ,000 each in 1981; after the most recent Shuttle disaster, the newspapers cited the "volume-production" cost as 00 per tile. While the costs are high and the tiles delicate, their function is wonderful - although the surface of the tiles are exposed to re-entry temperatures of up to 3000 degrees Fahrenheit (no man-made material can withstand such a temperature), inside the Shuttle - only an inch or so distant (thickness of the tile) is the aluminum floor of the Shuttle, upon which the astronauts walk (80 degrees).

Considering the complexity of the manufacturing process of the tiles, the large amount of them, the fact that they made up most of the vehicle's aerodynamic and control surfaces' exterior, their fragility, fix techniques, and that the spaces in the middle of tiles sometimes required stuffing - the amount of Flight Readiness Reviews, wherein tile problems were one of the major mission issues, can be imagined. However - the problems were solved - the discrete Nasa Administrators during the decade or so of Shuttle improvement were each briefed (technically-educated occasionally) and made the permissible decisions - the program becoming a colossal success for the U.S. And humanity for roughly thirty years.

The oil spill disaster, now nearing two months, seems no nearer to having a definitive administration plan than at its beginning. Why does not the President prescribe man (perhaps the Nasa Administrator or a Navy Admiral) to convene a "problem review" symposium: the world's smartest and experienced citizen - one room - for as long as it takes - to gift and deliberate upon ideas - and institute a plan-of-action?

What the owner doesn't know is that they have to negotiate! The real diminished value is much less than the dealers are quoting them. Come on guys! It's the rule of negotiation, start high, decree in the middle, you know? The point is that dealers won't put their opinions in writing, they don't want it to be exposed that they start way higher than they as a matter of fact believe when it comes to deducting for diminished value. The Fujita scale was introduced in 1971 as a way to rate the intensity of a tornado based on the amount of damage done to man-made structures and vegetation. Because many of the factors used by the Fujita scale were subjective and ambiguous a new scale was introduced. One winter evening I was working on the computer when the power went out. The freezing rain that had been forecast must have been the culprit. It was getting late so I went to bed figuring we would have power again by morning.
Thunder and lightning woke me a couple times, but then I heard something a little different. An explosive popping sound followed by what seemed to be a shower of sparks. In my minds eye I tried to picture the cause of this sound. An exploding power transformer with hot lines arcing around it? There is nothing like a puzzle to keep me awake; but I didn’t want to get up and lose the warmth I had built up under the blankets. Just drifting off again I heard the sound repeated but up the hill behind my house and more distant... more crackly sounding but still accompanied by the sparkling shattering sound my ears were now more tuned in to analyze. Suddenly realizing the impact this freezing rain was having I shot out of bed and ran to the window. Large tree limbs were on the ground. Major branches were bending under the cumulative weight of the ice; then noisily busting sending thousands of 3” icicles to break with a sparkly shattering sound.

Conversely if you cut far away from the trunk the branch collar is not near the cut where they can grow over the wound. Improper pruning cuts can hurt your trees.
Take notice of trees with dieback of the bark on branches and down the trunks. Often you can tell it was from a flush cut or an end cut. Other times it may be a storm damaged branch that wasn’t removed and it died back to the trunk and on down.
If removing a large limb, first its weight should be reduced to prevent tearing the bark when the branch falls. Make a shallow cut from the bottom of the branch a foot or so out from the branches point of attachment. Then finish cut from the top, above or a little further out on the branch. This leaves a lighter and more manageable stub. The stub is then removed while taking care to not remove the branch collar. This technique reduces the possibility of tearing the bark.

(4) WHAT YOUR MEDICAL DOCTOR AND/OR CHIROPRACTOR REPORT SHOULD STATE: Each “Injury Evaluation Factor” should be clearly stated within each of your final Medical Reports. For example: That your disability is solely the result of the accident. If there were any pre-existing conditions aggravated by your injuries? What treatments were administered and for what duration? What medications were prescribed, in what amounts and for how long? What symptoms or medical problems were such medications meant to relieve? Were there any adverse reactions demonstrated? Ask to read them before they're sent to the adjuster so you're sure it explains the nature, plus the extent and frequency of the pain that an injury, such as yours, will likely cause.

PROGNOSIS: This is the clearly stated information (regarding your personal injury progress) and should include: The part played by a pre-existing condition, if any? Is Art a Gift, Or Brain Damage?

In other cases, experienced artists go on to produce paintings that are as striking as anything found in their entire body of work. ~ Fred Balzac

Recently on one of the TV news magazines I saw a feature that linked brain damage (stroke) to personality changes that included an unleashing of compulsive creativity. This phenomena sparked my reading and that reading supported the premise of that TV show. It made me wonder. It made me wonder about myself.

I am not a well-known artist. Some people call what I do a hobby. For me, the art (the poetry, the doll making, journaling, blogging, jewelry making, the Paper Mache, the novels, and all that creative stuff I do) is not a hobby. I feel insulted when what I do is called a hobby. While I may lack talent, and I am unsuccessful by most of the measuring sticks on earth, I think of myself as an artist. What I'm wondering about right now is WHY. Why do I create? Why does anyone create? Why is my art so constantly on my mind? I've had no stroke. I'm unaware of any brain damage. It is certainly possible that I have some birth-defective brain that has changed my left anterior temporal lobe, but if so, I don't know anything about that.

I remember once, in a group session with Lili Parish, my shrink/friend, someone in the group implied that my abilities to paint pictures and write poetry were "gifts." The suggestion made was that some people have the gift, and other people didn't. I argued about this train of thought.

What I believe is that if you had drawn as many pictures as I have drawn, you would be at least as good an artist as I am, and you would probably be better. I am not sure how many little cartoons, and serious paintings I have completed, but I would estimate it is in the thousands. I have been drawing since before I started school. Instead of paying attention in class I was drawing on my notebook paper. I draw and write every day, and have missed days with my art only after surgery or when overwhelmed by my daily life [like the days I spent moving to Oklahoma City from Lakeland Florida.] In a similar way, as a kid, I demonstrated zero athletic skill. I couldn't throw a football. I knew guys that could throw like a pro, but that was a "gift" I did not seem to have. Of course those guys good at throwing footballs had been tossing a ball around for years.

The more you do what you do the better you will do what you do. This was my explanation for what abilities I had, as well as the abilities other people have that I don't. I am terrible at playing the Sitar. Does Ravi Shankar have a gift that I have been denied, or was he a gifted Sitar player because he spent his life playing the Sitar while I have never actually seen one in person?

This rationale goes a long way towards explaining talent, at least in my mind. In Renaissance Italy they didn't have a lot of historically great ballplayers, but their culture didn't care that much about a kids throwing ability. In Renaissance Italy they support art. So if a kid was drawing on the wall, and if some passing adult noticed the drawing, and said it looked good [for a kid that age], that kid would be encourage to do more of that activity. The more the kid is encouraged, praised, and urged on, the more they will do what is getting this positive feedback, and eventually they will have an artistic gift. In the 1940's if a little kid threw a rock and it went further than a passing adult thought was normal for a kid that age, they immediately would think, "Baseball!"

Another behaviorist shrink/friend of mine, named James Cail, use to say, "People do what they get paid to do." What he meant by that is that people can be paid with money, or just positive feedback, but if they are getting something out of the activity they will keep doing that activity. Vincent Van Gogh. only sold one painting in his life time, but that does not mean he was not getting paid. There were people in his life that admired, and supported and encouraged his artistic activities.

But maybe, just getting positive feedback, and spending your life doing a particular artistic activity is not all of the answer. The people on that TV show who had strokes started doing art compulsively and they had no life of practicing that art. They just suddenly had to be artists. Their ability can be questioned. Some of the work seemed especially primitive, but then no more primitive than modern art by a hundred other accepted and admired artists.

Could it be that creativity is always linked to some quirk of the brain, or were these stroke victim artists just a aberration, and that artistic talent is normally, and mostly often the result of the ole "practice makes perfect" sort of stuff?

Here is what I think. I want to believe that artistic ability is not a gift. Because that is what I want to believe, I look for quotes and data that supports that view.

Why do I want to believe that artistic ability is not a gift? Because I don't feel gifted. If it is a gift, then it is possible that I didn't get the gift, or that the size of my gift is small. If art is a gift then I am limited by that truth. If artistic ability is developed then there are no limits on what I could accomplish artistically. Not only can I go as far as I choose to go with my art, but this would be equally true for you. Anyone, and everyone could be and do whatever they wanted if they just put their mind to it, work art for it, and sustain their interest, motivation, and practice.

So while there may be little fissures in the brain that can contribute to a creativity compulsion, I still lean to the POV that artistic ability is developed by creating art.

How often have you experienced a power outage because someone crashed an automobile into a power pole? I'll bet it's been more than once. If you look around your city or town, you'll notice that the power poles run alongside the streets. This must be this way in order for the power companies to be able to reach and service them. As you can see, there are many good solid reasons to put power lines underground. There is a drawback, though. The cost of installation is higher. But considering all the pros and cons, it is apparent to me that the time to change over is now. If you think about it, I'm sure you will agree.

In San Francisco (USA) Thomas and Kim Champion gave birth to a little girl called Jessie. However, the happy bubble was soon to burst, because after a couple of days, Jessie began to develop severe jaundice, a common, but possibly a life - threatening illness if it goes untreated due to medical negligence.
Things for Jessie and her family started to worsen, when the doctors failed to treat and test her jaundice, which later developed into kernicterus, which is a preventable but debilitating and lifelong syndrome. As a result, Jessie now suffers from speech and hearing dysfunction as well as cerebral palsy and motor skills impairment.

Jessie is now five years old and her parents have filed a lawsuit in Alameda Superior Court alleging that Alta Bates Summit Medical Centre and other parties were medically negligent for failing to diagnose and treat their daughter's severe newborn jaundice. As a result, the parents are seeking compensation for lifelong medical care and special needs.

The medical negligence suit alleges that the doctors missed several opportunities to intervene and prevent her worsening brain damage. This is shocking, as Jessie's jaundice was noticeable within the first 48 hours of her life and was even brought to the attention of and noted by Alta Bates at the time.

This concern was faced by Alta Bates with a response that medical providers failed to consider the unreliability of visual jaundice assessments in dark-skinned newborns, hence they did not perform a blood test. Later, Jessie was discharged, without telling her parents about potential problems.

Jessie's attorney Cynthia McGuinn stated: "This tragedy was an unnecessary and completely avoidable medical complication that only occurs in cases of medical negligence. Jessie was visibly jaundiced within the first two days of her life, and her doctors noted it on her medical records but failed to conduct a simple, inexpensive blood test that would have identified here elevated bilirubin level and allowed for timely treatment to reverse this toxic process entirely."

Things started to get really bad, when after a couple of days, Jessie and her parents returned back to hospital as he jaundice had got so severe. However, medical attention was further delayed to the staff not working quick enough to test Jessie's blood. Eventually, a second blood test was produced which demonstrated a life-threatening bilirubin level.

McQuinn commented further on the suffering and distress Jessie has to go through daily which could have been avoided: "Now, due to her medical providers' negligence, this once healthy baby girl is celebrating her fifth birthday brain damaged and severely disabled, relegated to a wheelchair and completely dependent upon others for all aspects of her care. Our community, simply can't stand for another healthy child to become completely disabled from an easily detectable, treatable and totally reversible condition."

The suit alleges that, despite medical knowledge, there was no ambulance provided. Hence, more delay and failure to administer immediate medical attention all added to the severity of Jessie's personal injuries.
